City of Encinitas Sued Over Lack Of Wheelchair Access

Dennis Sharp, a disabled rights activist, has sued the City of Encinitas, California. The complaint alleges that street improvements in the City’s downtown failed to account for the needs of wheelchair bound individuals, such as Sharp.

The complaint alleges that the city has violated state laws and the federal Americans With Disabilities Act. Specifically, the complaint states that the city failed to install ramps connecting sidewalks with parking spaces and failed to include sufficient accessible handicapped parking spaces.

The complaint is asking the court to direct the city to include sufficient ramps and parking spaces to accommodate wheelchair bound and other disabled persons.

The Americans With Disabilities Act, passed in 1993, has been a catalyst for a number of lawsuits against governmental entities around the country.
